CREDIT POLICY

  1. All customers must have a credit application on file prior to receiving an open line of credit.
  2. Any non-government customer who requests a line of credit in excess of $55,000 must provide to LC Industries a financial statement with the application.
  3. All non-government customers will be advised in writing of the credit arrangements, which are applicable to them. Changes to such credit arrangements will be in writing.
  4. Any order that brings the total amount owed over the customer's credit limit is subject to having the order held until the account is paid down within the established line of credit.
  5. Terms: Payment terms are net thirty (30) days from the date of invoice. If a customer's account becomes past due, orders are subject to being held until the account is current.
  6. If there is any change in the management, ownership, or organizational structure of the customer's business, the customer must notify the credit department of LC Industries of any change in the ownership of the customer’s business. This notification must be given by way of certified mail.
  7. In the event of a default by the Purchaser in any of its obligations hereunder, Seller may exercise its rights of enforcement under the Uniform Commercial Code in force in the state of North Carolina. Purchaser submits to the jurisdiction of the state and federal courts of the State of North Carolina for the resolution of any legal actions arising out of the Agreement and agrees that venue for such legal action shall lie exclusively in Durham County, North Carolina for any state action, in which, Purchaser agrees to pay Seller's reasonable expenses, including but not limited to, reasonable attorney's fees incurred by Seller for collection of any indebtedness created hereby.
